COMPANY PRIVACY POLICY

This policy governs your use of this web site. It exempts dadba.org, dadba.com, dadbanetwork.com and the Downriver and Detroit Business Association from liability or limits its liability and contains other important provisions that you should read. Each time you use this web site, you acknowledge and signify that you have read, understood, and agreed to be bound by this policy as it then reads, and you warrant and represent that you are at least 18 years of age. If you do not agree with each provision of this policy each time you use this web site, or if you are not at least 18 years of age, you may not use this web site.

Information gathered at this site will be passed on to third-parties. Any information provided by you will be sent to individuals or companies we think can assist you in your needs. Any information received may be provided to anyone else without prior written consent of the consumer(s) or business(es). We may be required by federal, state or local laws/law enforcement agencies/courts to furnish information pertaining to previous or current transactions with the consumer(s) or business(es), providing that a request is received in writing.

Requests for information will be verified with the agency/agencies requesting information prior to releasing that information. Downriver and Detroit Business Association, its employees, heirs, and related companies are to be held harmless involving any information requests.

Questions regarding our privacy policy can only be accepted in writing. This is necessary in the event of any dispute that may occur in the future as well as to preserve the consumer or businesses legal rights.

Policing
The Site administrator reserves the right to ban either temporarily or permanently ban any member who does not comply with any or all Terms and Conditions set forth in this document. A three strike policy may be used and and will utilized on a per user/occurrence basis.  Banning membership is used as a last resort only.

Behavior prompting a ban by the Site administration:

  • Open public confrontation or argueing with another member.
  • Users who feel they have been unfairly treated are welcome to contact the Site administrator at info@dadba.org
  • Any attempt to circumvent a temporary ban will lead to that ban being made permanent. Circumvention includes re-registering under a non-banned username, changing IP addresses to evade an IP ban, registering a new email account of evade an email ban. Circumvention includes posting as an anonymous user.
  • Permanent bans are a last resort and thought is given before implementing them. While the Site may consider lifting permanent bans from time to time this is a rare occurrence.

Behavior

  • Posts are to be made in the relevant forum. Users are asked to read the forum descriptions before posting.
  • Users consistently posting to the wrong forum may be given a warning.
  • Members should post in a way that is respectful of other users.
  • Flaming or abusing users in any way will not be tolerated and will lead to a warning.  Members are asked to not act as "The administrator". If members note an issue which contravenes something in this policy document they are welcome to bring it to the attention of the administrator Only do this if the administrator has not replied within 6 hours. Do not respond to such topics yourself. 
  • Members should remember this website is aimed at a general audience, unless specified.
  • Members are asked to respect the copyright of other users, sites, media, etc. Users linking to or re-printing material without permission will receive a warning and their account will be suspended.
  • Spam is not tolerated here under any circumstance. This includes offering hosting services (charged and free), installation services, etc. Users posting spam will be warned and their post removed.
  • The Staff Of DADBA, Administrator, or Moderators reserve the right to edit or remove any post at any time, for any reason. The determination of what is construed as inappropriate, indecent, vulgar, spam, etc. as noted in these points is up to staff and not members or users. You will be given a warning first that your post will be deleted, you will then have the option to delete the post yourself prior to the administrator doing so resulting in a website service charge.
  • The above forum rules where applicable also apply to private messaging. Abuse of the private messaging system may lead to warnings (as above) and/or the revocation of private messaging.
  • Images and Avatars The Site allows users to link to the avatars of their choice and requires the images used to be in good taste and appropriate for a general audience. Images may not include reference to pornography, vulgarity, racism or hate. Avatar size is limited to 100 pixels by 100 pixels. Signature size may not affect the appearance or usability of the threads (ie causing the page to scroll sideways with normal resolution.) Users in violation will be given 24 hours to correct the image.
  •  If you require assistance please notify the Administrator , or Moderator.
    Downriver Exchange / DADBA allows advertising or products or services to registered and paid advertisers / members / sponsors only.
  • Users may include links to their websites however for advertising services to our users registration as a member will be required.
  • Any links placed to websites in profiles or posts that are deemed innappropriate for any reason The Staff Of DADBA, Administrator, or Moderators reserve the right to edit or remove any link at any time, for any reason. The determination of what is construed as innappropriate, indecent, vulgar, spam, etc. as noted in these points is up to staff and not members or users.

  • In the event you should not follow any of the polices, and have received a warning or have been banned, you will be required to cover all website technician work expense to correct the problems you have caused. As of 12-23-10 website hourly rates are a minimum of $55.00 per hour.


 
Disclaimer And Policy Regarding DADBA Meetings And Events

WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT for All DADBA Events & Meetings

1.   In consideration for receiving permission to participate in the DADBA I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE, . The Downriver And Detoit Business Association, The DADBA System, their officers, agents, servants, or employees (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or any of the property belonging to me, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted.

2. I am fully aware of the unusual risks involved and hazards connected with this activity, including but not limited to travel risks and/or . I hereby elect to voluntarily participate in said activity with full knowledge that said activity may be hazardous to me and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that my be sustained by me, or any loss or damage of property owned by me, as a result of being engaged in such activity, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES OR OTHERWISE. 


3.  I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage or costs, including court costs and attorney fees, that they may incur due to my participation in said activity, WHETHER CAUSED BY NEGLIGENCE OF RELEASEES or otherwise.


4.   I understand that Downriver And Detoit Business Association does not maintain any insurance policy, other than basic insurance coverage, covering any circumstance arising from my participation in this event or any activity associated with or facilitating that participation. As such, I am aware that I should review my personal insurance portfolio.

5.  It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above-named RELEASEES. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws where I reside or such circumstance may happen.


6.   I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Release for full, adequate and complete consideration fully intending to be bound by same.


7.I hereby elect to voluntarily participate in said activity with fullknowledge that said activity may be hazardous to me and my property.I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that my be sustained by me, or any loss or damage of property owned by me, as a result of being engaged in such activity, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES OR OTHERWISE
